I completely agree with this. But, anyone that's made money in business doesn't give a shit about your morality. Because that doesn't actually exist in this world. It's projected on.
Personally my view point comes from biblical perspective. This world is currently run by Satan. It's reflected in out goverment structures, entertainment and businesses. And, as such, if you play the game of capitalism, you have to understand it is no different to war. You either survive, or you die. And, yes obviously it's often a much more metaphorical death. But, as the money goes up, the stakes pf physical life and death go up too. But, the events in the human mind cannot distinguish this. So, the weight is as significant. And, if you want to survive, you have to outplay your opponents. Because they're as amoral as Trump.
So, if were are to play the game of IP, it'd be based on the law, which does support what I am saying. I've run businesses. And, had to understand the legality of what I can and can't do as a business myself. And, while it may seem like a grey area. Yes, web scraping is legal. But, what you scrape is not necessarily legal. In Australia you cannot scrape other people's intellectual property.
And, you are right, it's a gamble. But, if you're aiming to win. You have to understand the courts are not about truth. They're about persuasion. And, appearing to be the one that is correct. Nothing more. -

This is the exact same type of situation.
If my account has Sq(666*1/3) -5, and it's specifically the only time it's ever been used, and a data model houses that data.

No one gives a shit about copying vs theft, when it comes to IP laws. The language isn't modelled after computer terminology. And, if you're using said lanaguage based on computer operations, and someone was to tell me, copying isn't theft bro. I'd break their fucking arm. Then I'd sue them.

In all seriousness. And, maybe this is just Australian law. By Copyright IP covers any document, idea, creative process you consider. As long as you've got it in writing. It's aumatically granted.
I dunno how other countries do it.
BUt, scraping my data would be considered IP theft because it's intellectual. No physical. Although, it can be that too. -

This isn't an accurate portrayal of copyright laws. Though, I fully believe goverment would ignore IP laws when it's done by businesses they are interested in using.
But, infringement doesn't require you to physically take something. It's Intellectual Property. Your ideas. If they use it, based on your creation. That's an infringement.
Like video piracy isn't theft. But, it is intellectual property. Obtained by illegal means. People that claimed it not being theft, more amoral shitheads side skirting the reality they're law breakers, and deserve the death sentence.
So, if I find my IP scraped in data models. They'll be scraping some data scientists off the side walk. If the law won't protect me. Then they're as villainous as the people they target. So, I'll get the job done. -
