@Suiseiseki@BrodieOnLinux we're not talking about a git repo, I don't need anything related to git to fork the linux kernel. I can just have a copy of it in a directory. The only non-free code I'm aware of is firmware, which is only built into the kernel in the event you compile a kernel module into the kernel binary rather than having it as a module loaded at runtime. If you were to compile a binary kernel without any of the firmware in sys-kernel/linux-firmware you'd get a distributable kernel binary as the output.
I highly doubt it is not possible to bootstrap a system with such a kernel.
From that point, as long as the kernel headers are present and a toolchain is available, you can simply have the end-user's system automatically download and compile any necessary modules and firmware during OOBE
