- Embed this noticeI remember one female judge that basically told me that she was going to shift the cost of a partition (the forced sale of co-owned property) on to us if we didn't settle and despite black letter law that stated that division was to be based on ownership and equitable shifting was only allowed where there's some impropriety (breach of trust, perjury). Defending or requiring trial is not a ground for a sanction. When I pointed to the law on the issue, it only made her more angry because she was just fucking wrong, but couldn't admit it. I was smart enough not to mention how unethical her behavior was (threatening a sanctions for a protected exercise of due process). I didn't bend though and costs were eventually split according to code, because I twisted opposing counsel's arm, but she wasn't happy.
