@djsumdog People like to think that because that's the world most people spend most of their time interacting with: if you have an unpleasant neighbor, maybe you greet them somewhat less enthusiastically. It's how a society works: you have to have that kind of mindset to live in a peaceful town. But civilization is a thin veneer, or nobody would ever get stabbed, and it also tends to stop at the border.

@djsumdog @eriner High-profile cases are the worst cases for evaluating something like this. But that's not American law, those are all individual states.

      > bad, but better than the systems before it

@djsumdog @p No, that has to be permitted. If the government kidnaps me, breaks my leg and beats me, then attempts to push me through their gay court where I'll be adjudicated by their gay rules, completely divorced from any true legal system, then I need the right to select a champion.

        John Joe Gray
John Joe Gray (born c. 1950) is an American who identified as a sovereign citizen and was a fugitive from the law. He lived on his 50-acre, wooded ranch in Trinidad, Texas. He was involved in the longest-running law enforcement standoff in American history, lasting a few days short of 15 years, before the district attorney dropped the charges. Standoff The standoff began in 2000 when Gray jumped bail after indictment on two counts of felony assault. During a 1999 traffic stop in Anderson County, he allegedly attacked Texas Trooper Jim Cleland. A struggle ensued after Cleland reached for a .357 caliber handgun in the car that Gray was driving. Anti-government pamphlets and references to setting off a bomb on a highway overpass near Dallas were found in the vehicle. Gray was charged with two felonies: assault of a public servant and taking a police officer's weapon. After promising to have no access to weapons while awaiting hearing, he was out on bail before the judge held his bond insufficient, and ordered his re-arrest. Local Henderson County Sheriff Ray Nutt stated in 2011, "This kook...

So who qualifies for trial by combat? Is it just random volunteers in a pool? Does the State get a separate (but equal) pool?

If not, do you get to select your own Champion? Like, you could just select someone you hate from your childhood if you know you're guilty and want them to die too?

Wouldn't that create a society where no one wants to be friends for fear of being volunteered for combat duty? Fuck, it's hard enough to get out of jury duty!

Violence is risky. Even the winner is often injured, which could be mortal where a simple cut could kill due to infection. Language and trade allowed for people to bring some certainty to their relations.
