Honestly gleeful at the prospect of Musk suing Zuck for misappropriation, as discovery will reveal the apparent collusion between Dorsey/Bluesky, & Musk/Twitter.
Musk won't win claims against #Meta for #Threads because he hasn't tried to enforce against any misapp by #Bluesky, a direct competitor that hired Twitter employees & whose whole Board is ex-Twitter, & whose big attraction to users is that it's a copycat clone of Twitter - but Musk has never made a peep about it. And never will.

I'm sure Twitter shareholders would love to understand how the development of IP that they funded while Bluesky was a Twitter project, got transferred to an "independent" company, and at what price.

@Bam Yeah I assumed that Facebook had a competent legal department and that they would have already insulated those employees (unlike Bluesky, FTR). They were nefarious enough with Cambridge Analytica stuff that it's clear they are evil & competent.
I don't even care about any of that. This case is all about the affirmative defenses, which will allow Meta's lawyers to get all the docs on Twitter/Bluesky relationship & transfers of assets & any wrongdoing w/r/t shareholders or the public.

It is extremely vague. It looks like it was drafted on no information, just Musk telling them to do it. That said, it’s pretty easy to write a complaint with trade secret/misappropriation claims that can survive until discovery. Lawyers shouldn’t write them if the claims are frivolous or they know their client hasn’t defended the IP at issue, but there are dishonest clients and lawyers.

@chargrille How normal is it in these sorts of letters to not actually reference specific violations or things that Threads should stop doing? Because as far as I could tell skimming it earlier, the only thing they actually call out is that the app looks like Twitter, and right now you could field a baseball team with apps that look like Twitter.
It struck me as extremely vague, but then I don't read or write letters like these for a living

Melon just felt really insecure because zuck was bragging about all the sign-ups last night, so in order to salve that narcissistic injury he had an attorney shoot off a C&D. All the attention that C&D is garnering is the payoff for melon. Its called narcissistic supply.

You don't need a non-compete to bring a.misappropriation claim in CA. It's irrelevant to proving the elements of the cause of action, which is why the Quinn Emanuel letter doesn't even mention non-competes.
