  I think the medical battery is the trick. It's beyond malpractice. A battery is unconsented.
  
  Example: Doctor is to amputate right leg, takes left instead. It looks like malpractice, but isn't. It's straight battery. Consent was not given for the left leg. Forms and waivers don't cure this.
  
  I think it would be hard to say she consented to having someone else's baby (unfortunately, race can't be an issue in court). Nonetheless, given months of pregnancy, pain and suffering, emotional distress, especially in light of a couple that wanted their own child, that's probably a couple million at trial (assuming they pled it right).

  The counter argument to medical battery would be that she consented to having an embryo put in her and that's all they did.
  
  That returns it back to malpractice and triggers insurance.
