@VulpineAmethyst @dalias @marcan What if I patch SSH to only use ECB in my distro? Shouldn't I, as the distributor, be obligated to share the source of my modified SSH, so that my users know their SSH is not the same as the upstream version?

If you're just browsing a website, you're not making the work accessible (communicating it to others), so it's not really a usage restriction*. The language is a bit weird, because it can also apply to other works apart from software (like CC BY-SA 3.0). The licence was created by the EU commission, so I'm pretty sure it's legally sound.

It has the chance to be synonymous with FOSS, which is much more inline with the EU’s values of freedom and cooperation.
