The jury was deadlocked and then the prosecutor and judge basically openly conspired to run around NY law in dropping that first charge.

That means there was probably just a few souls on that jury, maybe even just one, who said, "I am not going to let an innocent man go to prison just so I can be done with this trial. I am going to do the right thing."

Daniel Penny is a very very lucky man.
