    The judge rules the cops conducted an illegal search and seizure violating Luigi Mangione’s 4th amendment rights, since they didn’t have a search warrant.

    All items found in Luigi’s backpack at the Pennsylvania McDonald’s will not be allowed at trial.

      Inventory exception is bullshit and is often used to end run the warranty requirement. For example, why would they need to photograph every page of the diary? Does the department do that with every book that find when taking an inventory, e.g. books in impounded cars?

      Like either all of the contents are allowed or none of it. Her "finding" the gun after the initial inventory would mean that initial search was flawed. Wouldnt that open up the argument for a breach in the chain of custody?

      Because looking in the bag at McDonalds was a search, and anything found was unlawfully found.

      The inventory at the station was an inventory. The purpose isn't to search for evidence, it's to record the contents for return, etc., like when you bail something. Plain view then kicks in.

      The inventory exception is very real and is often misused, but courts allow it. Be aware.

      Still, the point stands. If you admit that it wasn't directly on his person and even exempt some items due to lack of warrant and an illegal search and seizure, then how do you admit others within? It should be all or none. Fucking kangaroo courts.

      The real rule is be careful about what you have in you when taken into custody. As long as they wait to "inventory", it's in.

      Also note this isn't just about backpacks, a dui will lead to an inventory of everything in the vehicle, which is another example of how broad the exception is.
