      If they do, it's not a wise position. The GDPR applies to EU citizens, even when outside the EU.

      And when it comes to enforcing judgements... The EU has agreements with most of the rest of the world, including the US. Because it's not a jail term, the US is actually likely to uphold it.

      @shaknais @Cycrev They have ignored other fines by the EU in the past. Unless the US imposes the fines, this will not deter them.

      @zackwhittaker doesn't Clearview generally respond to gdpr violations with "we don't have a business entity or assets in the EU. You've made your judgement now let's see you enforce it"

      @darnell However, since the US *agreed* to uphold it in July, that situation is not likely to repeat.

      @shaknais The US is not enforcing the fines now. That is the issue here. It is unlikely they will either, as the company can contest any fines imposed as they do not have a presence within the European Union 🇪🇺.

      They have ignored fines in the past, & I doubt they will pay one penny to the EU.

      The US only designated Switzerland as the qualifying state in June. Laws take a while to take effect - the draft first went up five years ago.

      The US *will* be enforcing the fines, unless the executive order is overturned, but only very, very, recently did the EO come into effect.

      @shaknais My theory: any attempt to impose the fines will be overturned in Federal court & be seen as unconstitutional according to US law (especially with conservatives controlling the Supreme Court).

      I do not see the company paying any fines in the future.
