The two claims dismissed with prejudice that are hills I'd die on are ultrahazardous activity (fab) and Cal. Labor Code § 6399.7 (Right to Know / HAZWOPER retaliation). Apple retaliated against me as soon as I started asking questions about my Superfund office in March 2021, but for years claimed it was being supportive & wonderful, actually.
In reality, after my first email with concerns about the site, my bosses immediately complained to each other that I'm a fearmongering idiot.
Yet Apple's lawyers excluded my bosses from their witness list, claiming they're irrelevant to this employment lawsuit.
🧵 Apple kept telling me it finished the document production for my retaliation lawsuit claims even though it only gave me a few new docs. Most of the docs just raise more questions; & Apple still won't even tell me who fired me or when they decided to fire me. (Incredibly basic info for these suits)
I already had to file a Motion to Compel & Apple said what it gave me is fine & actually I'm the problem.

Apple redacted a message as Attorney Client Privilege, but neither are attorneys. Apple also won't provide a privilege log - so Apple had prob already looped in lawyers about firing me back in April 2021 & that looks pretty bad for Apple.
My March 2021 email with questions about my Superfund office also linked to the article about me getting sick in 2020.
EHS decided it was necessary to include the 3250 Scott fab manager in the convo about me, even though he doesn't work on my office. So they knew they almost killed me in March.
Yet Apple's witness list only includes the guy who quit 3yrs ago, & they also claim 3250 Scott is irrelevant to my claims.
In April 2021, a manager emailed my boss complaining my weekly status updates included content he said he's "not involved in" "so seems like something best addressed directly."
Boss escalates to Employee Retaliations, who escalates to HR, & all complain my updates were "personal" and not "within the scope of my role."
The updates? Saying I'm concerned about the safety of my office & I'm escalating concerns, noting I'm meeting with a local mayor, and noting I'm working on Right to Know projects
Apple excluded this HR Biz Partner from their witness list. Apple also repeatedly refused my complaints that they cannot claim ACP if there's no attorney in the conversation.
Apple offered no explanation as to why it was disciplining me 3 months before it put me on leave & over 4 months before I tweeted about ears or face Gobbling.
Every time I asked Apple what their defense is for the retaliation prior to Sept 2021, they changed the subject or pretended they had a different meeting to go to.

Sweeney's done a much better job with this then I have. I realized this year that Apple's been actively exploiting one of my personal traits - that I generally refuse to participate in pointless arguments & logical fallacies. So by default I ignore the noise, but because its Apple, leaving it unsupervised allows it devolve into Dante's Inferno.

The US Judge in my civil case just issued an order assigning a Magistrate Judge to oversee discovery. It sounds like the discovery Judge will also project manage us.
Now Apple will have to actually participate, & will have to stop stonewalling.
