Right after Apple somehow Jedi-mindtricked the Judge to dismiss tons of my key claims, and for admittedly no good reason - I got a random phone call that I'm 99% sure was Apple's lawyers - pretending to be an Apple worker & trying to get me to say I regret suing Apple. That showed me they're desperate.

@mcv That's not how any of that works, & I find it very strange that you are so emotionally invested in this exchange. I don't know why you feel it necessary to try to influence the voting choices of someone in a completely different country than you - but I think you may want to consider more productive hobbies.

🧵 There's no context provided in any of the press coverage about Luca stepping down as Apple CFO. The articles are like: no idea why this happened now! I could not find a single article that mentioned what I found in 2 hour of research: Apple was probed by the US SEC this year.

Apple violated regulation 2-1-301 when it built/installed equipment that causes air pollution without 1st getting permission from the gov; then violated -302 by operating for ~8yrs without required permits. Apple violated 307.1 by dumping illegal amounts of NOx & CO into our air.

On Aug 29 2024, BAAQMD formally cited Apple for violating air pollution regulations 2-1-301 & 2-1-302 with their stupid secret fab. Then on September 12 2024 (prob after an inspection?) they cited Apple for four more violations - 301 & 302 again, and also for 9-7-307.1 for illegal emissions of "gaseous pollution."

🧵 Back in July, I filed a formal complaint with California Air Resources Board about Apple's stupid secret fab.

I send them records & told an investigator about how Apple almost manslaughtered me.

The BAAQMD has now already cited Apple for *6* formal violations (illegal air-dumping).

Here's a copy of the receipt of my complaint. I had requested Judicial Notice of it in the civil lawsuit, but the Judge apparently ignored it.

The two claims dismissed with prejudice that are hills I'd die on are ultrahazardous activity (fab) and Cal. Labor Code § 6399.7 (Right to Know / HAZWOPER retaliation). He said they're dismissed and I can't even try to amend. That's unacceptable.

Just to be clear, the lawsuit was not dismissed completely.

There were still many claims left, and most that were dismissed were given leave to amend.

However, we're fighting for justice. Justice means all meritorious claims should go forward. So, 9th Circuit, here we come!

I filed the Notice of Appeal to the 9th Circuit, and for now paid the fees on my Apple Card (the only card not maxed out yet, also kinda poetic).

Per the usual these days, I have about 2 weeks of work left to complete over the next 48 hours for the US Dept of Labor appellate brief.

We've also been waiting a very long time now for the Judge's decision in the civil lawsuit... I'm nervous & trying not to think about it.

Apple retaliated against me as soon as I started asking questions about my Superfund office in March 2021, but for years claimed it was being supportive & wonderful, actually.

In reality, after my first email with concerns about the site, my bosses immediately complained to each other that I'm a fearmongering idiot.

Yet Apple's lawyers excluded my bosses from their witness list, claiming they're irrelevant to this employment lawsuit.
