In addition, it does not unconditionally apply to digital goods; it entriely depends upon the terms of sale (in particular you may be familiar with the EULA clause ‘this software is licensed, not sold’; this is different from the EU, where you always have right of resale)
But that is about resale, not use.
It is not clear to me from reading the Berne convention text that you even have the right to use a piece of software you have received absent an explicit license; but even if you do, it is not clear that you have an unrestricted license to do so.
Consider as a point of comparison that you have an implied right to read a book, and you have an explicit Berne convention right to quote short excepts of it, but that you need a license from the copyright holder to read it for a public audience or adapt it into a another language, a TV show or radio play.
