In California, trial courts are allowed to use the decisional law of any appellate court even if the appellate court in their direct line disagrees. So a trial judge easily go any direction by making pick and choosing who to follow.
At least in federal, if the 9th Cir. has a decision and the 8th Cir. disagrees, I know the trial court will apply the 9th.
