They can choose to disregard evidence for a myriad of reasons. I don't have to believe Billy Joe Jim Bob the town drunk was actually abducted by aliens. But his testimony that it happened is still a form of evidence.

This person has thoroughly demonstrated they're willing to change the definition of words as it suits their case though. I don't know what you expected.
