You can't punish a man for something a woman does without his consent unless you revoke personhood rights from said women and legally declare her property of the man who is taking responsibility for said actions. To do anything else makes her privileged (like present day) and makes men second class citizens (like present day). Founding fathers and olde worlde judges didn't have a world where women could semi-anonymously press a magic rectangle and have a line of men outside her door to boink her faster than the time it takes to boil water.
