Here in California, a woman can get a temporary dvro pretty much over the counter (judge does have to sign) on affidavit without any notice or hearing for the restrained party. There's no action "malicious prosecution" or "abuse of process" if she lies. A DA could charge, but they never do.
If you violate it, it's quasi-criminal, and it doesn't matter if he application was false and no final order would have issued. Basically, you're on parole.
I've only done one DVRO matter in my career, for a friend, and he was under a temporary for 18 months because of a slow docket. He had to turn in his guns under it.
