The issue that those Jersey MD(s) got nailed for is that they were apparently 'in-network' with insurers (they had agreed to accept payments for services at the insurer-quoted rates) and were trying to charge concierge fees on top of that. This does seem to be a bit shady. If you're going to do concierge medicine you should probably do 'out-of-network' billing and be up front about it. It sucks for your cash flow situation (significant delays in collections) but that's the nature of the world.
