Part of that is geography. Mexico for example lives in mountains on the other side of impassable desert between them and the border. Is this a failure of their laws that they can't contain the migration? If the worst elements of society are leaving voluntarily, I wouldn't be in a hurry to stop them to keep them in jails I have to pay for. Let someone else execute them or whatever.
