It isn't, the trademark and GUI is proprietary and I would expect the company behind it wouldn't like it if someone else was going around redistributing (freedom 2) the browser under the same name and branding.

That being said, Vivaldi is, for the most part, just a Chromium fork with a fancy nonfree makeup, completely redundant and retarded web browser, browsers in general just fucking suck and have dubious licensing.
