I think most jurists took the court seriously on this point. Most people intuitively recognize that weighing decisions based on race violates equal protection. The thing they don't want to admit is that some races on average just don't perform as well as others at certain tasks. Thomas has ironically been gently hinting at this for decades going back to even his own nomination. He knows that most niggers are genetically inferior in the context of a republic.
