so like literally shining a flashlight at some noise after 11pm in the woods is illegal because they were trying to deal with night hunting which is like so much less of a safety problem now with nods imo
but like if i'm camping then it's technically illegal to shine my flashlight in the woods after 11pm if there happens to be an animal doing something, like perhaps making noise??????????
just because someone could end up shooting a gun? what????
@w0rm@dsmc.space there's so little states that i feel like i can live in and i think it's fantastic and then this shit shows up. i mean like i appreciate that i could 3d print glock lowers technically even if they'd be annoying to have to dispose of or whatever but like, does that really matter if its technically illegal to shine a flashlight past 11pm outside if I hear a noise in the dark? where the fuck am i supposed to live
@rubylith@raru.re yeah apparently they passed these laws because they were having a lot of problems with night hunting but now this means me having a flashlight and conceal carrying means i can basically be fucked with by any cop or DNR officer at any time. bruh
@shibao that law has to be only applied to citations made by the game warden or something
having such a vague law in the first place is goofy, wouldn't it make headlights or any exterior lights illegal if they happen to cross paths with an animal?? crazy
@w0rm@dsmc.space yeah i mean i guess this isn't really anything compared to the mag bans and stuff, i'm just so tired of having to aware of every single law passed for every single edge case ever to avoid having to get dragged in the court for idk, shining flashlights at things at night because i live my life a certain way where i basically have a gun on me at all times. it really does feel like modern life is really just meant for you to spend all your money consuming funko pops and staying inside your apartment sometimes
@theorytoe@ak.kyaruc.moe yeah for my lifestyle all i have to be aware about are any of the following:
- city gun ordinances - county gun ordinances - state red flag laws - state laws regarding 3d printers that may be used to print guns even if i have no intention of printing a shitty plastic lower just because i own a 3d printer - state gun storage + transportation laws - state magazine bans - state ammunition storage/possession laws - state body armor laws - state self defense laws - state hunting laws that may apply while conceal carrying or carrying a flashlight apparently even if i'm not even attempting to hunt yet - state vehicle regulations - state suppressor laws - state motorcycle/helmet laws - general federal gun and suppressor laws (NFA) - ITAR laws since i own a tube that is subject to ITAR
these are all the things that i have to be aware of and i haven't even begun to talk about everyone's favorite topic, healthcare
like sure there are great reasons for all of these and they are all enforced very unevenly but when it's technically illegal to shine a flashlight on your own property past 11pm something has gone horribly wrong with modern society
@theorytoe@ak.kyaruc.moe also night vision counts as spotlighting too so looking at deer on your own property at night is illegal by the way straight to jail if you've ever done that
@picofarad@noauthority.social i've only ever heard stories about asshole game wardens cuz i don't like to fish and i've never been hunting although i want to do hunting eventually later
@shibao i called my wildlife foundation and asked about legislation like that in my state and they said "only unlawful if you're hunting" and i basically quoted what you said to them to ensure we were using the right framing, "in a tent can't use flashlight... someone may have a gun".
I have heard our dept of wildlife and fisheries ("game wardens") are real assholes. i do know where one lives, though.
@shibao if you read the handbill/booklet that is at every place that provides licenses in exchange for cash, you should be ok. Some states have great laws, like in mine, if you're hunting, law enforcement is not allowed to harass or interfere. This is also true of fishing, so you can carry an AR and a fishing pole anywhere.
so just be cool and you'll never have a problem, most likely.
@vandergail@kokoro.garden honestly im kinda surprised you can night hunt if you register with the state but it shouldnt be banned imo, getting shot at by a hunter should just be actually enforced as criminal negligence if people are actually worried about it. but yeah shining a flashlight on an animal is illegal in our state lol. also when r we getting boba together arent u nearby
