Not sure if people know what an “administrative stay” by a U.S. Supreme Court Justice is. Basically it is a temporary timeout, having no bearing on the merits of a case, to give a the Court time to review these. 1/

Roberts’ grant of an administrative stay in the Abrego Garcia case did not include any explanation for the stay. He did request a brief on the merit from Abrego Garcia’s attorneys by today at 5 pm eastern (they were already filing as this request was made), which might mean that the Court will not drag its feet on assessing the district order to return Abrego Garcia from El Salvador. But there’s no real way to know how long this administrative stay will last. 2/

I’m sure that Roberts himself is hoping that somehow the Court can duck taking a position on the lower court’s jurisdiction and on the remedy it specified, the order to return Abrego Garcia. The only way this can happen though, is if the Trump executive voluntarily returns Abrego Garcia, mooting the need for the Supreme Court to rule - very unlikely - or if Abrego Garcia is confirmed dead, mooting the need for the remedy - sadly, more likely, though no indication now that he is not alive. 3/3

That said, short of the return of the deceased's body, how can we even believe either El Salvador or Trump?
