Naomi Cunningham KC, representing Peggie, said Upton was well aware that some of her female colleagues were not happy with her using the changing room. Upton replied: “I would disagree. I am aware that some people are uncomfortable with trans people but I don’t think that automatically overrides a trans person’s right to access a changing room which aligns with their gender identity.” Cunningham said: “The reason why some of your female colleagues might be unhappy was obvious. You’re male. At least some of those women might experience this as an invasion of privacy.” Upton replied: “I’m not male. Why they might be uncomfortable with me is up to them. I would disagree that I’m male and would disagree that my presence in the changing room is an invasion of privacy in their space.” It was disclosed by Peggie’s legal team that she had been sexually assaulted “several times” by a GP during her long career in the NHS, and when asked whether that “justified” Peggie’s feelings, Upton replied: “It’s a very difficult situation when someone has very serious trauma. I do not think it justifies excluding people.”

I was one the the rabbits in court as the jury and a weasel had also got onto the jury, pretending to be a rabbit. When questioned, the weasel loomed over us and said, "I'm a rabbit; aren't I a rabbit? Say I'm a rabbit!" And funnily enough, all the rabbits agreed that he was a rabbit. I can't think what reminded me of this. 🤷♀️
