TikTok will not be banned in the USA. It's just another last-minute drama story to keep the people entertained, IMHO. The only thing that could happen is that tomorrow the TikTok app will be temporarily removed from Apple/Google App stores. Let's focus on real news and how to fight the far right, ok? :)
Of course TikTok itself can decide to block all connections from the US to make their point. They will do that for just a few days, if at all. Trump has already declared that he might sign an Executive Order to delay the ban by 90 days in his usual non-committal nonsense way of talking (possibly paywalled https://www.washingtonpost.com/technology/2025/01/18/trump-tiktok-ban-90-day-reprieve/ )

It's not the main reason why they lost the 2024 election cycle but it surely didn't help matters at all especially how they gave the middle finger to young people by voting for the ban.
Biden is perfectly right to say this is now Trumps problem. If Trump gives in, it (IMHO) shows that the US administration can be blackmailed by a Chinese company. That's a good start for Trump II :)
And, as expected (see further up in this thread), Trump will sign an executive order tomorrow to restore access to TikTok in the USA. Now proposes a 50/50 joint venture instead of full ownership transfer. (link to post in ALT of screenshot)
IMHO: ByteDance has played the incoming president and made him lose face while they could keep their chin up (which is important in Chinese culture, as far as I have learned). Instead of a ban and a full ownership transfer, Trump now offers to sign away the ban and the demand for full ownership by an US company- Instead he more or less begs them to come to the table and work on a 50/50 split. Well played, ByteDance, well played. And now the infighting amongst republicans and MAGAs can begin :)

Donald Trump (again) mainly fears for his image and publicity. I wouldn't be surprised if part of the more secret talks in the last 24 hours was getting a promise from ByteDance that they will make sure that only positive posts about his inauguration show up on the TikTok timeline ;)
Aaaand TikTok is coming back online in the USA. The #DramaOfTheDay is over, as I promised from the start. This is all so predictable. What’s the result? Clickbait. Free marketing for TikTok and Trump. No real change. Just a few hours of downtime for US audiences and creators.
Legal experts question how Trump could grant an extension of up to 90 days as the law is in effect and its validity confirmed by SCOTUS. The 90 days can only be granted if a new US based owner is in the process of closing the negotiations.
So Trump will possibly ignore the rule of law on his first day in office. That's impeachable, innit? ;)
So what he most likely will do is issuing an executive order that stops authorities he can control from taking action as demanded by said law. If that will hold remains to be seen. IMHO Trump only cares about seeing nice TikTok's about his inauguration and he hasn't wasted any thoughts on anything beyond that. It will be interesting to see how some of the hardcore republicans act now.
And with the republicans having a majority in house and senate, nothing stops them from repealing or replacing the law at short notice with a new one that allows for this joint venture style construction that Trump hints at. Storm in a teacup, IMHO.
So, in closing. Who is the real winner here? Simple. ByteDance. They managed to effectively render a SCOTUS approved law unenforceable by satisfying the narcissistic needs of the incoming president and can continue their operations just like before for at least the next few months. That's quite something, when you think about it.
@jwildeboer This is incorrect. The ban is not a spending bill. Because of this, a repeal or modification would be subject to the filibuster rule in the Senate. A simple majority is not enough.
@iansmcleod AFAICS, the current law says that only the Attorney General will conduct investigations into violations and pursue enforcement. So it seems quite logical to me that Trump can order the AG to NOT investigate or pursue enforcement for an undefined time?
@jwildeboer Yes. Non-enforcement remains an option. I was speaking specifically to your assertion that they could actually repeal or replaced it. (Attempted to do this by slotting this reply under that toot.) Under the current rules, on a purely partisan basis, they cannot. They'll either need democratic votes in the senate or they'll need to nuke what remains of the filibuster.
@iansmcleod Got it. So I guess non-enforcement will become the chosen path, at least for the next few weeks/months. The law in its current form would not allow for the joint-venture idea that Trump is floating around anyway, AFAICS. So some new legislation would be needed anyway. My suspicion is that in a few weeks or months no-one will really care about this anymore and through non-enforcement the status quo will remain.
