     Penal law has three purposes, rehabilitation, incapacitation, and deterence. If it's failing to deter, then punishments need to be enhanced or more public.

     Early on, during the 16th and 17th centuries, the penal system primarily rehabilitated. Back then, the inmate population was exclusively White and they were trained in various trades, so they could work after being released.
     
     The need for long term incapacitating only became the norm after we freed the slaves and imported non-Whites.
     
     I'll let you guess why, and it's not racism.

     Yes. We've given up on rehabilitation of the inmate population generally. It no longer works on average, as a changing population diminished returns, and equal protection requires they all be treated the same regardless of race.

     I think what you really need is the ability to apply rules based on race / culture, i.e. you lose the right to equal protection upon conviction to the extent it facilitates penal purposes. You give rebuttable discretion / a presumption of validity to the states.
