Only so much I can go into as the entire thing is still ongoing, but tl;dr my dad married his therapist a few years ago and she was very obviously using him for a free house and free cars and etc.She made it a point not to respect his wishes in regards to his service, and went on a shopping spree with the funeral benefit money instead.
She's also denied my sister and I access to the home to retrieve sentimental things with no cash value.
She steadfastly refused to open probate because she wanted to keep accounts open to spend money out of instead. I applied to be executor of the estate but she had first crack at it. There was a hearing to decide who should be executor and she brought a high powered attorney when I wasn't even sure she was going to show up. Their argument was that probate didn't need to be opened at all, and she spewed lie after lie after lie in the hearing. I got a call an hour ago and

I also assume the court thought that though she was preferred by statute that she was unfit to act as administrator? -

Just picture a Karen. Do not adjust your mental image in any way. I'll upload a picture later.She actually tried to tamper with my phone to delete footage of the service because she was talking mad shit about me and my sister. She later said the purpose of the recording was to "catch her in a lie" which honestly speaks a lot to her state of mind and was one of the biggest mistakes she made in the hearing.

Probates are statutory commission in most states, meaning the attorney gets paid out of the estate, as does the administrator, so no up front fees, and in this case, the estate could have a claim against the wife that needs to be litigated in order to liquidate it (reduce it to a judgment). I wouldn't litigate pro per.
