For many of them it already is, as they run BusyBox/Linux and don't include a written offer for source and installation information as required by the GPLv2.

Provided the copyright infringement isn't intentional or at least it isn't being done for profit - yes.
If the copyright infringement is for profit and the infringer has been doing it intentionally and refuses to immediately either stop distributing or comply, the copyright holder has the option of pursuing it criminally.
