This needs to be answered in two contexts:
In this specific scenario: As daily participant in the traffic wars as bicyclist, I have a very low opinion of human drivers. But it is realistically possible a human driver would have reacted better. That creates a liability for Cruise, but has absolutely no impact on whether they should be allowed on the streets or not.
In general: if self-driven cars generate less accidents with injuries, I would rather argue for a ban of human drivers (and accept incidents like this one). If self-driven cars generate more accidents with injuries, they must not be allowed on the streets at all.
As I read it: not the accident caused the ban but the attempted coverup.
