No. Elon is acting on behalf and at the request of Donald Trump. The problem for Elon is that he is liable for the way he does whatever he's asked to do. I imagine he discussed the terms of his pardon some time ago.
The question is can the president do what Elon is doing on his behalf. The corollary is has the Supreme Court immunized Trump from liability for breaking volumes of federal laws, so long as he pretends he was acting in his capacity as president when he broke them.

Trump and Musk lie about everything. The USG has forfeited the right to have its statements accepted as true in court, and in compliance with the law and a lawyer's professional obligations.
The DoJ should have to prove every fact and assertion it makes in court, from the identity of the lawyers representing it in court, to who runs what and who has purportedly been given legal authority to do whatever.
