That's an oversimplification of the legal system and case law in the US does not support what you just stated. I'm sorry but that's only one component, an impartial third party.

There was no consul given
No ability to defend against accusations (How do you know the person you detained is even Japanese?)
You didn't even charge the person with anything you just detained them indefinitely

Whether or not a judge determines a law/order as constitutional is separate from someone receiving due process
