We really need to do something about the judiciary. Maybe limit the jurisdiction of the district courts, and create a new jurisdiction for preliminary injunction regarding executive action. That litigants can forum shop to find that one judge who will say "no" is nearly a blanket restriction on all executive action if the plaintiff's bar so elects. There's always that judge.
