There is no reasonably way to check the claims, so the only safe assumption is that it is spyware unless proved not to be.

Convincing a developer to make something source-available isn't the greatest - the developer should really be respecting the users freedom by releasing it as free software (too bad I'm not sure if the macos store actually allows software on it to be free - as the iOS store requires that all cr...apps be released under a proprietary license after all).
