my two cents on this:
From a user experience perspective tbh I LOVE port imports.
I kept hearing that fedi was this awesome place where you can move servers whenever you want, yet every time I migrated between mastodon servers I lost my past.
Same if I just wanted to change my username since that involves migrating as well
And the thing is yeah we can download our archives, but you know, some of us want social networking as opposed to a personal private diary/journal
But as far as how the law will handle these, that will be quite interesting. We will have to see how it shapes out, but I suspect feds will have to gain extensive experience on how the particular fediverse software being operated works to argue for or against the legitimacy of posts and prosecutors will have to call on expert witnesses to support their claims
At the end of the day though, before it reaches those levels, they are far more likely to scrape the profile as-is (maybe with a warrant to get a point in time archive) and present it to the subject of their investigation trying to get them to indirectly confirm they made those posts.
(Pls no hate LOL) I was police at one point. And there were times where I would not ask "did you do X" I would ask "why did you do x" or "how did you do x" and often people would confess as to why/how as opposed to outright denying it.
SEVERAL more factors existed around the conversation and how they were caught of course, but I am just saying that how someone is approached with evidence, even when it isn't 100% concrete yet, has a potential of uncovering the truth behind it and also validating it. If they deny it, that's when I think the expert witness and data forensics teams will do much more for the case
