Why should broadcasting on any frequency be made illegal?

For different frequency bands tasks for different use cases, it's okay to define acceptable TX power limits and the transmissions format to ensure those bands remain usable for everyone, but it really isn't too hard to track down interfering transmitters with modern technology and shut down them down.
