以前、元の英語を調べて訳語について考えたのですが、私は「合理的調整」あるいは「道理にかなった調整」といった訳語がよいのではないかと考えます。

最初は「合理的調節」としたのですが、「調節」よりも「調整」のほうが日常で使われている自然な言葉です。

最初そのように考えた理由ですが、まず「配慮」という訳語が英和辞典のどこから出てきたのかが不明です。訳語は絶対に英和辞典にあるものでなければならないということはなく、場合によっては適切な訳語を訳者が考える必要がある場合もあるはずですが。

ともかく言われている通り、これでは、個人同士が対等に交渉するはずのことが、他方が温情主義的に一方的に決めたことを障害者に対して提示するかのようです。

元の英語の "reasonable accommodation" が英語でどのように説明されているのかを見ます。あえて英語だけを提示して、日本語訳は付けません。米国労働省障害雇用政策局（Department of Labor's Office of Disability Employment Policy：ODEP）のサイトの "Accommodations" というページを見ると、それは

"Under Title I of the Americans with Disabilities Act (ADA), a reasonable accommodation is a modification or adjustment to a job, the work environment, or the way things are usually done during the hiring process."

と説明されていて、modification（修正）や adjustment（調整）なのです。

『オックスフォード現代英英辞典』第9版（Oxford Advanced Learner's Dictionary, 9th ed.）を見ると、 "accommodation" は

"3 [C, U] (formal) an agreement or arrangement between people or groups with different opinions which is acceptable to everyone; the process of reaching this agreement
◇ They were forced to reach an accommodation with the rebels."

と定義され、用例が示されています。

また、『新英和大辞典』第六版（研究社）の "accommodation" を見ると、

“2 適応，順応，調節，調和〔to〕．
3〔紛争などの〕調停，調節，和解（reconcilement）〔of〕．
¶ the accommodation of differences, opinions, etc.
¶ reach [come to] an accommodation
　折合いがつく，和解する．
4 （人に）好都合な事，便宜（を図ること），親切，好意；もてなし．
¶ for your accommodation
　ご便宜のために
¶ through the friendly accommodation of...
　…の（ご）好意により
¶ It will be an accommodation to me if you will meet me tomorrow.
　明日会っていただければ好都合ですが．”

という訳語と用例があります。上記の英語の説明を見れば分かるように、"reasonable accommodation" の "accommodation" には、2や3の訳語が当てはまります。

ですから、"reasonable accommodation" の訳語は、「しかるべき調節」や「合理的調整」や「道理にかなった調整」が適切でしょう。
