The question of who can serve (constitution) is separated from (state executed) laws regarding how names appear on the ballot and elections are executed. In theory, it is the electoral college that ultimately is supposed to exclude a candidate unqualified to serve, maybe even congress, or perhaps the supreme court refusing to swear in.
