Lets put it this way, would you ever trust anything from an entity that will do anything to get more money (a business) further than you can throw it?
There isn't really a "spirit" of free software that can be violated, it either free or proprietary, Linux is simply proprietary unless the malware is removed.
Also, I would recommend against writing "Linux kernel", as that makes the massive confusion worse by reinforcing the erroneous belief that Linux is more than a kernel.
I would recommend writing 'the kernel, Linux', or 'Linux, the kernel' or just 'Linux'.
