   A reporter asked the veteran prosecutor whether his office’s decision to try Clancy for first-degree murder in the strangling deaths of her three children was “insensitive,” because, the reporter claimed, 11 jurors “didn’t necessarily believe” the prosecution’s case.
   “Insensitive?” he shot back. “Insensitive is killing 3 children. Insensitive is ignoring those facts. We have an obligation to stand up for those [kids] and seek justice, and make sure they get justice.” He added that if people cannot understand that basic moral reality, he does not know how to answer the question.

     The full note from the foreman said he juror wanted them to "give in regarding doubt." That's a carefully crafted statement that could be read either way.

     The defense spun the note to mean the person was voting guilty and then assumed it was a man. Nothing in the note mentions gender.
     
     The defense then asked that the juror be removed. The prosecution had to oppose because removal could set up an easy appeal for Clancy. The media then further spun this as... the prosecution is defending the guilty vote.
     
     I don't knew which way it was, but that's the point.

     In many species, women kill lovers and children as a normal process, even during mating. Why should we believe this primordial instict was lost to humans just because we have counter-faculties. Think of it like a low level program that usually gets overruled, but not always.

     I too am old enough and wise enough to be agnostic. I often tell clients who want to know the map... "we'll cross that bridge if and when the we get there. Either that or we can read the code of civil procedure, evidence, etc and play choose your own adventure." I don't believe anything until it happens.
