I'm not a criminal lawyer, but generally, the fed doesn't prosecute unless the state doesn't get the job done. There are exceptions, and I believe a federal prosecution would take precedence under the supremacy clause.

@Humpleupagus Since you're the resident expert, how does it work when both the state and federal government charge someone with a crime? Right now the North Carolina court is looking like a clown show, but I know the DoJ has also charged the subway stabber with a federal crime: https://www.justice.gov/opa/pr/justice-department-charges-light-rail-attacker-federal-crime

Can he be tried for the same thing at the state and federal level? Isn't that double jeopardy, or something like that...Or is it not technically the same crime somehow? Do the feds have to wait for the state to run their own case, or do the cases go in parallel?

This case has gotten me far more interested in understanding how the legal system works.

Yep, that's her on a "women of the movement" page.

This is who is responsible for deciding what happens to DeCarlos DeJuan Brown Jr., who stabbed Iryna Zarutska.

Normalfags also forgot about that nigger murdering the Ukrainian girl in North Carolina.

I went to check on the case just now and of course the site with the court documents is down: https://portal-nc.tylertech.cloud/Portal/

Hopefully it's back up soon. The case number is 25CR394562-590. I think he has some hearing scheduled for the 15th or 16th. Last I checked, there was a hiccup in getting the hospital to comply with transferring his medical records to the police.

Maybe they're just doing maintenance or maybe someone decided they just don't give a fuck about maintaining some gay legal docs site anymore.

Oh would you look at that, the nigger court is doing nigger things.

There was originally supposed to be a hearing on October 16, but now that date has been changed to April 30 of FUCKING NEXT YEAR.

The case has been reassigned to Karen Eady-Williams, who I can't find a picture of anywhere except for this one from 2019, and I'm not sure that's the right person but it sure fits the profile.

Regarding double jeopardy, no. Double jeopardy is jurisdictional. A person could be tried in a state court by the state, win, and then be tried in a federal court. Just like you could be tried in two different states for kidnapping if you took someone from California to Nevada, which could also land a third federal charge since you crossed state lines.

I like the felony murder rule.

If you're engaged in a dangerous felony, and someone dies as a result, you're guilty of murder even if you didn't directly kill the person.

      Example:

You and your buddy go to rob a bank. You take black squirt guns, instead of real guns. After entering the bank, your buddy pulls out the gun. A bystanders who is carrying consealed draws his weapon and shoots your friend dead. You're going to jail for murder.

You. It's kinda like foreseeability in tort law, along with a duty of reasonable care. Could a reasonable forsee your buddy getting whacked? yes. Would a reasonable person act In such a way as to avoid your buddy getting whacked? Yes
