The problem they'll have is that all the creators being sued explicitly said they were doing it to take views away from Ethan's video. They have very little plausible deniability to hide behind.
@Hoss I didn't watch much but these are copyright claims and the people being sued will claim fair use. Sargon of Akkad won a fair use case where he'd just clipped and titled someone else's content. I think reaction videos are probably safe.
I mean, I fucking hate copyright if I'm being honest. I'd abolish the whole legal construct if it were up to me, but Ethan has them in checkmate here. And since I hate the people about to get bent over the table in court, it's entertaining.
@Hoss We'll see, I guess. There's a whole reaction industry that would be nuked if the court rules in his favor. The text of the suit asks good questions though.
@restful Fair use doesn't apply, he picked the three women he did because they spent large sections of their "reaction" either not present, not commentating, and in general not transforming anything.
One of them spent more time doing bong hits than actually engaging with the video.
They might STILL have gotten a fair use claim but they established intent by telling people to watch their stream of it so Ethan got less views.
Honestly if Ethan loses any of these copyright law is dead. @Hoss
