@Dan_Ramos the tough part is proving she’s guilty of lying when there is no proof he did or didn’t commit rape because she says there wasn’t consent and he says there was.

@Dan_Ramos ya. I’m just saying in general, yes women should go to jail for falsely accusing a man of rape, it just gets hard to prove in some common scenarios. However, women and men could greatly avoid those situations by never going to private places alone until in a serious relationship. But hey, I’m old fashioned and think that’s nothing but wise and don’t think that’s too much to ask and not impractical.

Also, a criminally false report would have to proved beyond a reasonable doubt. So just because a man is proved innocent doesn't entail the report was crinimally false. So any prosecution and conviction would really just catch the sure cases. The risk to the legitimate report that fails at prosecution wouldn't result in a charge against the woman. -

There can be evidence other than he said she said. Some rando breaks into her house, beats her, leaves bruises and biological evidence behind, and she scratches him, etc. there's evidence it's rape.
This is actually why the common rule used to be that it wasn't rape if she didn't fight. Not fighting was not necessarily consent, but evidence of a struggle cemented the case.
Women who are "date raped" could easily put up a fight. In fact, that's a safer situation to fight in than the rando. So date rape should be the most suspect claim and the most highly scrutinized. -

Exactly what I’m getting at. And with rape it’s often just he said, she said. And if there is no other proof besides “she said”, then he shouldn’t be convicted, but that doesn’t mean he didn’t do it. However, if it is proven that she indeed lied and knew she was lying, then she should be convicted of a crime, imho. -

Yea I understand. I said “often”, not always. But I don’t know real stats and how often there are date rape accusations without physical evidence. I just know about the accusations against celebrities and public figures are many times he said, she said and even if he isn’t convicted his reputation is destroyed… and in some occasions even if a Democrat.?? I 100% agree. I'm just saying we could make some very clear evidentiary hurdles that have to be met before a conviction could be had. That would stop flase accusation and related prosecutions early.
In order to strike a balance between legitimate rape and protecting men from false accusations, requiring physical defense may be reasonable. She's gotta give more than a single scratch too, since that could be faked during consensual sex. There has to be sufficient evidence to show there was a full on struggle.
That would at least do away with "date rape" type accusations. Black out or drug rape is something I'd have to think about. -

There is ultimately no perfect justice system for rape and that’s why men should stay away from some women, especially if a high profile person, and women shouldn’t ever get blackout drunk with men they don’t know or fully trust. Used to be “not very lady like”.As far as roofies, I think they can test for that and women should be taught to immediately consult with the police if they think something like that happened to them.
