Yeah. I'm no expert on capital punishment, but I'm pretty sure that the separate jury phase and right to introduce mitigating evidence is a matter of federal constitutional law, not state law. I don't see a court saying that can be avoided because the person is in the country illegally.
A better statute would have said that the fact the person is in the country illegal is probative as to the application of capital punishment.
