   Today, the UK Supreme Court ruled that gender equality laws do not include trans women.

   Here is why this ruling is nonsensical.

     It also sets a precedent.

     Tomorrow, the Equality Act and similar laws may be attacked again, so that women, including cisgender women, see laws protecting them made dependent on their ability to become pregnant.

     This transphobic decision is now being presented by some groups as a victory for women's rights: in reality, it naturalizes male domination, and defines inequalities as the consequence of biological characteristics rather than social structures.

     Trans women are even more likely than other women to find themselves living below the poverty line, and excluded from the job market altogether.

     This is a backwards reading of how male domination actually works: women are not a dominated group in society because they can be pregnant, it is because they are dominated in society that being pregnant in 2025 generates discrimination in the workplace.

     Trans women, just like many other women who can't become pregnant, are just as discriminated against in the workplace as others, and also suffer from sexual and sexist harassment.

     The transphobic activist group whose complaint led to this ruling was attacking the Scottish government for their decision to include trans women in public employment parity measures.

     The UK Supreme Court ruled in their favor, stating that the Equality Act 2010 must exclude trans women, as it relates to issues such as maternity and pregnancy.
