   The term 'non-crime hate incident' describes an incident which involves an act by a person which is perceived by another person to be motivated by hostility or prejudice towards people with a particular characteristic, i.e. race, religion, sexual orientation, disability, transgender identity.

     @Flick I thought the Miller case had already established that they were illegal. Or are the police above the law?

     @KeepTakingTheSoma No, Miller just established that his NCHI was unlawful, not that they all are.

     Miller took Humberside Police to court for their actions. The court found that the application of the Hate Crime Official Guidance to Harry Miller’s case was unlawful, with his gender-critical views well within the scope of free speech protection. While the court held that recording NCHIs themselves were not unlawful, Miller is appealing this judgment, and on 9-10th March his appeal will be heard at the Court of Appeal.

     @Flick Thanks. I also thought that one of the Home Secretaries had told the police to stop recording them.
