The question is whether the acts are in the course of his official duties. Unofficial acts are only protected if prosecution would affect the functioning of the executive generally (that the risk of prosecution would deter a president from carrying out his official duties / making decisions related thereto, etc). -

As for state crimes, I assume they'd be stayed until he's out of office. Otherwise, states would regularly use their police powers to interfere with the executive and in violation of the Supremacy clause. -
