   this is why they will likely use a judo technique - leverage against the system if they use the forced recess in that the system will be deciding against two bad options and choose the one it things is better.
   
   Thus this wouldn't be effective in the future because it wouldn't be choosing from two bad options

     @Jens_Rasmussen recess appointment is made when senate is "unable" to confirm appointments - called "recess" because traditionally it was an appointment made while the senate was in recess.

     What's that supposed to mean?
     I am now assuming that appointments having to be confirmed by the senate is a formality, and not a rule?

     @Jens_Rasmussen correct, and I think they've been reappointing the recess people, but in either case, it's an abuse of the system on both sides.
