I have good and bad news about this federal ruling out of the Eastern District of New York: https://reason.com/2024/07/26/courts-close-the-loophole-letting-the-feds-search-your-phone-at-the-border/ Good: there's now at least one federal district in which CBP can't search people's electronic devices at the border without probable cause and a warrant. Bad: the headline of this article, "Courts Close the Loophole Letting the Feds Search Your Phone at the Border," is wrong. This ruling only applies in the district in which it was made, not nationwide. #privacy#LawFedi 1/?
P.S. There are only two ways this ever becomes the law across the entire country: a) a liberal Supreme Court; or b) a Democrat-controlled Congress. Vote accordingly.
If the government appealed the ruling to the 2nd circuit and the circuit court upheld the ruling, then it would be binding on the 2nd circuit, but still not on the entire country. But the government isn't going to appeal, exactly because they don't want to risk losing on appeal and having the ruling become more widely applicable. 2/2
