     It wasn't unknown, there's a video of her talking about public uses of the model from other companies. It wasn't a secret that this wasn't a model made specifically for her. The only thing not known was if she owned the rights to use the model. Which it seems like she is asserting she does, unless she believes anyone can use = anyone can make products, in which case she's stupid.
     
     My personal question is why didn't mythic catch that, either they're stupid or Filian has gone this far with no management.

     Nobody would be letting that slide. I think the only reason why not is if a lawsuit happened Filian could just change models, meaning damages could not make up the cost for lawyers to deal with it. Still I would have put her on notice if they really didn't want Filian to do this. If Filian continued to merchandise after a public statement not only would she look bad but companies wouldn't want to deal with the potential copyright infringement. There you protected your rights without major money lawyer involvement.

     This will be pretty interesting.
     
     I'm not quite sure why the author never made an attempt to wrangle in copyright, it would be kinda strange they didn't know about the uses until now. However it could have been a foreign copyright issue and not worth dealing with. But with a Japanese company involved now it probably is worth dealing with.
     
     I wonder WTF mythic is doing, because as the largest indie vtuber the question of "does she own the rights to her model" should have been the first thing dealt with as someone arranged these merch deals. I highly doubt Filian did all these deals herself.
