It would still be proprietary, after all, Notch did complain about the freedom the GPL family ensures.
You'd have to be braindead to say no to billions of dollars - I would have said yes, but then proceeded to use a small fraction of the huge amount of profit to pay developers to clone everything in minetest to btfo microsoft. -

Yes, there was something in the contract that demanded he cease all involvement in minecraft and maybe even games.
You could do the moral thing and break such proprietary contract to betray humanity, except in a way that doesn't cause legal consequences, for example by anonymously offering bounties for mineclone development in monero (if you do it properly they'll never be able to prove it). -

Even if they were to sue and manage to prove such, they'd only be entitled to a few million in "compensation" at best, as it's not like minetest has anything to do with minecraft.
